Filing a Takedown Notice
Captain Printing complies with the U.S. Digital Millennium Copyright Act (DMCA) and removes infringing content upon request. If you believe your intellectual property has been unlawfully copied, you can submit a takedown notice. Before doing so, please ensure that the material does not qualify under the “fair use” doctrine.
If you’re unsure about your claim, consult legal counsel. Submitting a false takedown notice may lead to legal consequences, including liability for legal fees and costs.
To file a takedown notice, email us at support@captainprinting.com with the following:
- Identification of the original work you believe is being infringed, including registration certificates if available.
- Description of the infringing content and its location on our platform.
- Your contact information, including your name, address, and email.
- A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the content owner.
- Your electronic or physical signature.
Upon receiving your takedown request, Captain Printing will notify the user responsible for the content and allow them to respond. Processing your request may take up to 10 business days.
Filing a Counter-Notice
If you believe a takedown notice for your content was mistaken, you may file a counter-notice to have it reinstated. Send your counter-notice to support@captainprinting.com with:
- Identification of the removed material and its location prior to removal.
- A statement under penalty of perjury that you believe the removal was due to error or misidentification.
- Your contact information, including name, address, and email.
- Consent to the jurisdiction of the Federal District Court in your location (or, if outside the U.S., in Captain Printing’s jurisdiction) and acceptance of service of process from the complainant.
- Supporting documentation for your ownership or right to use the content.
- Your electronic or physical signature.
Captain Printing will forward your counter-notice to the complainant. If they do not pursue legal action within 14 days, you may request to have your content restored.
Responsibilities and Liability
- User Responsibility: Users must review and comply with copyright and intellectual property laws when uploading content. Do not upload content that may infringe on others’ intellectual property, including copyrights, trademarks, or publicity rights (e.g., name, image, likeness, or signature).
- Captain Printing’s Rights: We reserve the right to remove content that infringes intellectual property rights and terminate accounts for repeat infringers.
